Biography
Ben Grimsley advises clients across South Carolina on creditor rights and financial services matters in both state and federal courts. He has more than two decades of experience representing a wide range of creditors—including banks, mortgage servicers, equipment and auto financiers, and seller-financiers—in cases involving mortgage default servicing, replevins, collections, and creditor representation in bankruptcy proceedings. He particularly enjoys engaging with his clients to find alternatives to litigation and foreclosure, as loss mitigation can often achieve the best result by minimizing legal costs while maximizing recoveries.
Ben also counsels regional banks, credit unions, and community lenders in the financial services sector, focusing on the origination of commercial loans and providing guidance on daily operational issues. His extensive experience representing lenders in problematic loans and related litigation gives him a unique perspective when structuring new transactions—he understands how loan documents are tested when loans do not perform, and he applies that insight to help clients craft stronger, more effective loan structures on the front end.
